Terms of Service

1. Acceptance
By creating an account or using PayClaim (“the Service”), operated by PayClaim SAS (“we”, “us”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of the Service
PayClaim provides automated debt recovery workflow software. The Service generates and sends escalating email sequences on your behalf. PayClaim is a tool — it does not provide legal, financial, or collection agency services. You remain solely responsible for the accuracy of the data you enter and the legal compliance of recovery actions taken using the platform.
3. Account Responsibilities
- You must provide accurate and complete information when creating your account.
- You are responsible for safeguarding your password and for all activities under your account.
- You must notify us immediately at contact@payclaim.io if you suspect unauthorized access.
- Organization owners are responsible for managing team members and their access levels.
4. Acceptable Use
You agree not to use the Service to:
- Send communications that constitute harassment, threats, or fraud.
- Pursue debts that are not legitimately owed to you or your organization.
- Violate any applicable law or regulation, including consumer protection laws and GDPR.
- Upload malicious content or attempt to access other users' data.
5. Data Processing
You act as the data controller for the personal data of your debtors. We act as a data processor on your behalf. Our processing is governed by our Privacy Policy.
6. Limitation of Liability
To the maximum extent permitted by French law, the Service is provided “as is” without warranties. We are not liable for indirect, incidental, or consequential damages. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.
7. Termination
You may delete your account at any time from the Settings page. Upon termination, your data will be permanently deleted within 30 days.
8. Governing Law
These Terms are governed by and construed in accordance with the laws of France. Any disputes shall be subject to the exclusive jurisdiction of the courts of Paris, France.
